It would seem the first step in preparing for an argument is to secure your chompers, then your rifle.
If you slow it down, he shot straight up in the air. He also never used the words "I'm going to shoot you and kill you." In an American court, this is unlawful discharge of a firearm.
Maybe a minor felony at best.

Unfortunately, the law doesn't quite work that way... A threat has to be articulated in a very specific manner:
"I'll kill you" - NOT a legal thread
"I'll shoot you dead!" - NOT a legal threat.
"I'll shoot you in the head with this gun and kill you" - A LEGAL threat.
Even then, it's still (in most states) a misdemeanor; Communicating Threats
Of course, they'll get that guy on Trespassing, Communicating Threats, Unlawful Discharge Of A Firearm, Brandishing A Firearm For the Purpose Of Intimidation Or Threat. Maybe a few more.
It looks like he intentionally raised the rifle to point upwards before he squeezed the trigger. At the end of the day, it'll be plea deals, maybe some jail time, definitely a shitload of probation, no contact orders, etc...
