Bad Car Accident

I was involved in a car accident today. Some asshole pulled out of a parking lot going FAST, swerved around someone, and smashed into me. My car did at least a 360 degree turn into the other lane. A driver in the other lane almost hit my car after my car stopped. He had to hit his breaks hard.

The guy who hit me hit the back door on the passenger side, crushing it in to about the middle of my car, thus sending it flying. When I got out I looked at it and figured seriously that if it was the drivers side, I probably wouldn't be telling anyone what happened. My head slammed against the door when it happened. I was wearing my seatbelt. Airbags didn't deploy. The police said in their opinion, and how they would write it up, would be that it was the other drivers fault, 100%.

I have almost total coverage on my car, so I will probably get a check for more money than my car was even worth. I think it is totaled. The frame must be bent. The tires on the right side were both bent in and about to break off. Lots of damage.

The other driver got arrested. I didn't find out for what, but I think he had a suspended license. The police did tell me though that the car was his and that he had insurance on it. That would have really sucked if not.

Here is my question.. Should I sue this asshole? Here is how I think. If an accident is a simple accident.. I'd never sue. Shit happens. I've caused one before. But when you get someone being a total fucking dickhead driver, going nuts, going REALLY FAST with no regard for other motorists safety.. should I sue his insurance company and get two checks instead of one?

Oh yeah, and I'm fine. Just really sore ribs, and some bad bruises I believe I'll see in the morning. My head is killing me too, but I don't think I have a concussion.

On a serious note, unless there's proof the driver slammed in to you on purpose, don't sue.
This whole running to court the second something happens american folklore is ridiculous imo, the only thing it does is raise the insurance bills nationwide.

I probably wont. But how is it in Holland with drivers? Around here the majority of them are terrible, vicious and lots of times deadly. It's absurd. I'm pissed.

Like I said, I wouldn't even think of suing usually if it were a regular accident, and this asshole wasn't driving like a fucking POS.

Anyways, I'm not as pissed today, although my body hurts a bit more. As long as I get my insurance money and the guy doesn't try to somehow claim this was my fault, I'll just leave it be.

It's not that bad here tbh, besides the boy racers, elderly turtles and women parking, the majority of drivers here have a decent understanding on how to drive a vehicle without turning it into a weapon of mass destruction.
the fact that getting a drivers license here is not as easy as doing a run around the DMV parking lot might have something to do with that.
