Police Body Slammed For Going On Suspicious Early Morning Walk

Since when does the USA have a national curfew ? This is wrong. Harassing a private tax paying citizen bc of your own stupid suspicions! This isn’t Natzi Germany , people can walk in public at any hour of the day! I get up to go jogging at 5:00 am! And he’s got his kid with him gimme a break. Like he’s really going to break into a business wearing gym shorts and a kid at his side ! Cmon ! He’s not even black !!?

Failure to ID is a secondary offense, you need to be arrested for a real reason and then if you fail to identify you can be charged for it.

Hope he gets some semetic lawyer to sue and look for serious money.

Depending on what state you live in, sometimes your required to i.d. and you actually don't have to be arrested to be charged with failure to i.d. if the officer believes crime is afoot,
and also for traffic violations you have to i.d no matter what state your In.

Nope... Probable cause and/or reasonable, articulable suspicion would still be needed.

Driving is not applicable here...

Say he's up on a ladder looking into a window, or seen trying handles of doors or moving windows. Then you have it and now the officers have probable cause to take him.

But out just walking at 5am, no way...

Thiss is now a Section 1983 offense and he can win easy. But the damage is still done to him and his kid...
