I think both parties have to avoid an accident but most places give the traffic already on the freeway the right of way and merging traffic must yield to the existing freeway traffic, but quite a few drivers think you are supposed to let them in, see it all the time.

exactly, it's a courtesy to move over but not legally required...it is legally required for entering traffic to yield to existing traffic
