Nah. He bears at least 50% of the blame. This type of accident requires both parties to not be paying attention for it to happen.

First, I thought she would be the one to suffer as it was grabbing all the attention initially. Then noticed there wasn't any children warning.

However, that human was lucky, driver was slow enough and used the break at the correct time.

That's why the Dutch way of opening your vehicle door is being taught in a lot of countries: open the door with your right hand, you are forced to turn your head and see if anyone is approaching. We haveva lot of idiot cyclists but it also prevents you from getting hit by other drivers.

If it aint Dutch, it aint much. Consider this proven.
