If the guy wanted to kill people two of them were standing over him.

The context could have been the first guy we see could have been armed, shot the guy on the ground however the guy got the gun away and shot him before wandering off and dropping to the ground. Hence the guy the cop shot was the "good guy" and since he was so fucked up he had no idea what was going on and the cop seen the gun and killed him.
