A West Virginia man who impregnated an 11-year-old girl avoided jail and was sentenced to five years probation as part of a plea deal. He was also ordered to register as a sex offender and undergo therapy.
Michael Joe Adkins was convicted of raping the young girl at his home in Ona, West Virginia between October 2010 and February 2011. The girl was forced to get an abortion in March.
He and his wife Amanda Adkins were charged with a range of sexual assault offences, The Daily Mail reported.
According to the Herald-Dispatch, Michael Adkins entered a Kennedy plea agreement two years ago which allowed a conviction without him admitting guilt or explaining his role in the crime.
He was sentenced by Cabell County Judge Paul Farrell after Judge Alfred E Ferguson rejected an earlier plea deal without prison time. Adkins was given five years probation and 50 years of supervision on 16 November.
A family member of the victim's told Judge Farrell that the now 18-year-old victim continues to live in fear of Adkins. She allegedly cannot go to the bathroom without thinking he is lurking nearby.
Connor Robertson, defending, said Adkins has been under the supervision of the court since 2011 and has only had issues with minor speeding tickets. Robertson argued that his client would only need to be supervised for a few years, but Farrell insisted on the maximum.
I'm going to be blunt: I hope you screw up during those 50 years so I can send you to prison," Farrell told Adkins as he sentenced him.
"If you violate any of the terms and conditions in the next 50 years, then the court can send you to prison- and I'm hoping that's the case, because you should go to prison for what you did."
Amanda Adkins, now estranged from her husband, pleaded guilty to child neglect in 2015. She agreed that she subjected the victim to a dilation and curettage procedure in March 2011, the Herald-Dispatch reported. and was sentenced to 18 months probation and 10 years supervised release.
