Generally, you should never assume that a driver is going to do what they are supposed to do. They were both careless, 50/50.

It's really this woman's own fault that she was hit by the car. That could have easily been avoided by paying attention. Ultimately, the woman was hit by the car because she walked out in front of it without looking. That is most definitely not the fault of the driver. The driver did not make her do that. It was her own undoing.

Seen many incidents like this. Where sometimes the parents, sometimes kids and sometimes both get hit and lose their lives. People just assume like they are walking in gardens and any vehicle coming will itself be attentive enough to not hit anybody.
