Generally, you should never assume that a driver is going to do what they are supposed to do. They were both careless, 50/50.

It's really this woman's own fault that she was hit by the car. That could have easily been avoided by paying attention. Ultimately, the woman was hit by the car because she walked out in front of it without looking. That is most definitely not the fault of the driver. The driver did not make her do that. It was her own undoing.

I'm not absolving the driver of their part. I'm just saying the woman is an idiot for getting hit by a car while crossing the road.
